Jimmy Aja is a product of CODE Informatics, an unconventional IT and Business solution providing company, with many other products and services under its name.

By using Jimmy Aja’s Service, you agree to subscribe to newsletters, marketing or promotional materials and other information Jimmy Aja may send. However, you may opt out of receiving any, or all, of these communications from Jimmy Aja by following the unsubscribe link or by emailing at info@jimmyaja.com.

3. Purchases

If you wish to purchase Jimmy Aja’s services made available, you may be asked to supply certain relevant information including but not limited to, your company name, Email ID, Logo etc.
Jimmy Aja reserve the right to refuse or cancel your order at any time.
Payment against purchase/subscription shall be made by you within 15 days upon receipt of bill. In the event there is a delay in payment for more than 5 days from the due date, you shall be liable to pay penalty of 1.5% per month, on the delayed payments from the due date of payment. Jimmy Aja shall be relieved of its obligations under this Agreement in the event of non-payment of the Fees or expenses due and shall retain the rights in the Services for which the amount is outstanding.

4. Subscriptions

Services are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles will be set depending on the type of subscription plan you select when purchasing.
At the end of each Billing Cycle, your Subscription will automatically renew under these terms and condition, unless you cancel it or we (service provider) cancel it. You may cancel your Subscription renewal by contacting info@jimmyaja.com customer support team.
Should payment fail to occur for any reason, Jimmy Aja reserves the right to terminate your access to the Service with immediate effect.

5. Modifying/Terminating Services:

Jimmy Aja reserves the right to modify, update or discontinue our Services, or any features or portions thereof, without prior notice. You agree that we can suspend or terminate your right to access our Services at any time for any reason without notice, obligation or liability to you.

6. Free Trial

Jimmy Aja may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial").
At any time and without notice, Jimmy Aja reserves the right to (i) modify Terms of Service of Free Trial offer, or (ii) cancel such Free Trial offer.

7. Fee Changes

Jimmy Aja will provide you with a reasonable prior notice of any change in fees to give you an opportunity to terminate your Subscription before such change become effective.
Any continued use of Service after change in fee shall be construed as your acceptance of change in fee.

8. Content

Jimmy Aja’s Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material (“Content”). You are responsible for Content that you post on or through Service, including but not limited to its legality, reliability, and appropriateness.

11. Accounts

When you create an account with Jimmy Aja, you guarantee that you are above the age of 18, and that the information you provide to Jimmy Aja is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your subscription on Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with Jimmy Aja’s Service or a third-party service. You must notify Jimmy Aja immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
Jimmy Aja reserves the right to refuse service, terminate subscription, remove or edit content, or cancel orders in our sole discretion.

Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Jimmy Aja. Service is protected by copyright, trademark, and other applicable laws. Jimmy Aja’s trademarks may not be used in connection with any product or service without the prior written consent of Jimmy Aja.

13. Copyright Policy

Jimmy Aja respects intellectual property rights of others. It is Company’s policy to respond to valid infringement claims regarding content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

14. Confidentiality:

Confidential information shall mean any information disclosed by one party to the other party, in any form including without limitation documents, business plans, source code, software, technical/ financial/ marketing/ customer/ business information, specifications, analysis, designs, drawings, data, computer programs, any information relating to personnel or Affiliates of a party and include information disclosed by third parties at the direction of a Disclosing Party and marked as confidential within 15 days of such disclosure. Confidential Information shall however, exclude any information which (i) is/ was publicly known or comes into public domain; (ii) is received by the Receiving Party from a third party, without breach of this Agreement; (iii) was already in the possession of Receiving Party, without confidentiality restrictions, at the time of disclosure by the Disclosing Party; (iv) is permitted for disclosure by the Disclosing Party in writing; (v) independently developed by the Receiving Party without use of Confidential Information; (vi) is required to be disclosed by the Receiving Party pursuant to any order or requirement from court, administrative or governmental agency, provided that the Receiving Party shall give the Disclosing Party prompt written notice of such order or requirement and an opportunity to contest or seek an appropriate protective order. The Receiving Party agrees not to use any Confidential Information for any purpose except for conducting business with the Disclosing Party, or otherwise agreed in writing.

15. Error Reporting and Feedback

You may provide Jimmy Aja either directly at info@jimmyaja.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Jimmy Aja may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Jimmy Aja is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant Jimmy Aja and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

THESE SERVICES ARE PROVIDED BY COMPANY ON AN “AS IS” AND “AS AVAILABLE” BASIS. COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM JIMMY AJA IS AT YOUR SOLE RISK.
NEITHER COMPANY, JIMMY AJA NOR ANY PERSON ASSOCIATED WITH COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. TO THE FULL EXTENT PERMITTED BY LAW, JIMMY AJA EXCLUDES ALL REPRESENTATIONS, WARRANTIES OR TERMS (WHETHER EXPRESS OR IMPLIED) OTHER THAN THOSE EXPRESSLY SET OUT IN THIS AGREEMENT.
COMPANY’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THIS AGREEMENT IS LIMITED TO THE FEES PAYABLE UNDER THIS AGREEMENT.

19. Termination

Company may terminate or suspend your account/subscription and bar access to Service immediately, without prior notice or liability, under its sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.
If you wish to terminate your account/subscription, upon written notice you may simply discontinue using Service.

20. Governing Law

These Terms shall be governed and construed in accordance with the laws of Pakistan.
Company’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in effect.

21. Changes To Service

Jimmy Aja reserve the right to withdraw or amend Service, and any service or material Jimmy Aja provides via Service, in its sole discretion without notice. Jimmy Aja will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, Jimmy Aja may restrict access to some parts of Service, or the entire Service, to users, including registered users.

Jimmy Aja may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

23. Force Majeure:

Neither party shall be liable for any failure or delay in fulfilling the terms of this Agreement due to fire, strike, war, civil unrest, terrorist action, government regulations, act of Nature or other causes which are unavoidable and beyond the reasonable control of the party claiming force majeure. This provision shall not be construed as relieving either party from its obligation to pay any sum due to the other party.

BY USING SERVICE OR OTHER SERVICES PROVIDED BY COMPANY, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
